JIO FOOTBALL PLAY ALONG 2021

I. CONTEST DESCRIPTION:

1. Jio Football Play Along is a skill-based game conducted by Jio Platforms Limited (“JPL”), which can be played on MyJio App or JioTV App (hereinafter defined).

II. DEFINITIONS:

1. For the purposes of these Terms and Conditions, the expressions used as shown herein-under shall have the meaning ascribed to them as shown herein-below:

• “Company” means JPL and/or such of its affiliates, associates, representatives or service providers as may be nominated by JPL from time to time
• “Match” means a football match played as part of the Tournament (hereinafter defined);
• “MyJio” means the application where the PAG can be accessed during the Tournament;
• “Play Along Game” or “PAG” means the quiz titled “Jio Football Play Along Game” which will be played by the Play Along Participant (“PAP”) in accordance with the Terms and Conditions;
• “Play Along Participant(s)” or “PAP" shall mean any person who registers and/or participates in the PAG and who (i) is above eighteen (18) years of age as on the date of participation; (ii) is a citizen of India and not residing in the states of Andhra Pradesh, Nagaland, Sikkim and Tamil Nadu (iii) is of sound mind and health and (iv) agrees to enter into and participate in the PAG in accordance with the Terms and Conditions;
• “Points” shall mean eligible points earned as determined in accordance with the Terms and Conditions which are considered for Leaderboard.
• “Prize(s)” shall mean any or all prize(s) won by PAPs;
• “Terms and Conditions” means these terms and conditions governing the PAG, as stated herein in entirety and as may be amended by the Company from time to time;
• “Stipulated Time” for the purposes of the PAG shall mean the period until which the Company permits a PAP to answer any question forming part of the PAG
• “Tournament” means 8th season of Indian Super League scheduled to be played in India starting from 19th November, 2021 as per the schedule available at below link: https://www.indiansuperleague.com/schedule-fixtures;
• “Winner(s)” shall mean any winner(s) as may be determined by the Company from time to time, which shall be governed by these Terms and Conditions.
• “Jio subscriber” is a subscriber of telecom services provided by RJIL. Any other subscriber is a “Non-Jio subscriber”.

III. PROCEDURE TO PARTICIPATE IN THE PLAY ALONG GAME

1. 1. Participation

• The PAPs should participate in the PAG by registering on MyJio or JioTV. The PAG will be available on MyJio or JioTV as per the schedule available at https://www.indiansuperleague.com/schedule-fixtures starting from 19 November, 2021(“Schedule”).
• The Schedule could be added to, modified or cancelled based on programming / technical requirements / issues or in the event the Tournament is for any reason rescheduled, extended, cancelled or terminated early or for any other reason whatsoever.
• The mobile number from which the registration is received will be used to identify the PAP as a unique identification number. We urge PAPs to use numbers where they would be clearly identified as the PAP of the PAG. The entries received from MyJio and JioTV will be treated as two different Participants
• Any entry for participation in the PAG is not transferrable..
• The PAP may be required to furnish necessary supporting documentation as proof of age, address, name, photo identity and nationality that may be required by the Company at the time of awarding a Prize to the eligible Winner.
• The Company has the right at any time to require proof of identity and/or eligibility from PAP. The Company may, at its discretion, contact the PAP(s), if required, for any clarifications needed for the information provided by the Participant and Participant will provide the requisite information.
• The failure to provide proof or affidavit of eligibility, including the proof of name, address and correct date of birth within the time as stipulated in the Terms and Conditions or supon request by the Company may result in disqualification from the PAG. The Company also reserves the right to disqualify a PAP in case where a discrepancy is found to exist in the information furnished/provided/stated by the PAP during the conversation with the Company or any of the Company’s sub-contractors and vendors in the PAG, and/or in the information stated in the documents furnished by the PAP at any time.
• All personal details and information requested by and supplied to the Company by each PAP must be truthful, accurate and in no way misleading. The Company reserves the right to disqualify any PAP(s) from the PAG at its sole discretion, should the PAP(s) at any stage supply untruthful, inaccurate or misleading personal details and/or information.

1. 2. Registration

• Download the MyJio or JioTV from the app store for iOS or play store for android. The PAG is not available on KaiOS.
• PAPs can share the link, with their friends / family, to play the PAG. The recipient can select the link to download MyJio or JioTV, if not already installed and commence the registration process.
• Participation in the PAG shall be subject to the terms & conditions, and privacy policy of MyJio and JioTV available at https://www.jio.com/en-in/myjioapp-terms, https://smumcdnems03.cdnsrv.jio.com/jiotv.data.cdn.jio.com/policy/termsOfUseJioTv.html, https://www.jio.com/en-in/myjio-privacy-policy and http://apigw.jio.ril.com/help/jiotv/privacypolicy/ respectively.
• PAP(s), who are not Jio Subscribers, can play the PAG through MyJio or JioTV by verifying their mobile number by confirming the OTP received on their mobile number. Such PAPs cannot proceed without confirmation of their mobile number. Please note that the Company will be able to get in touch with the PAPs, if needed, only if the mobile number the PAPs have input is registered with the service provider in India.
• After confirming the mobile number, the PAP will have to click on ‘Jio Football’ banner under the “JioEngage” Tab of MyJio or JioTV to start playing the PAG.
• The Company may, in accordance with the laws prevailing in certain Indian states, bar individuals residing in such states from participating in the PAG. Currently, PAP residing in the Indian state of Andhra Pradesh, Nagaland, Sikkim and Tamil Nadu may not be able to participate in the PAG as the laws of this state bar persons from participating in games of skill.
• A PAP will be considered as a different user on each platform
• A PAP has to mandatorily provide confirmation concerning age eligibility, citizenship and acceptance of Terms and conditions and also a declaration that he / she is not residing in the states of Andhra Pradesh, Nagaland, Sikkim and Tamil Nadu in order to participate in the PAG.
• In the event, a PAP’s location details captured by MyJio or JioTV App indicates that he/she is residing in Andhra Pradesh, Nagaland, Sikkim and Tamil Nadu then such a PAP will not be permitted to proceed to sign up for the PAG
• PAP(s) have to mandatorily enter their profile details in order to proceed with PAG including their profile / fan name, state, gender, age group and favourite team (“User Profile”).
• PAP(s) have to then click on the ‘Play Now’ tab on the PAG homepage to start playing. Please note that the ‘Play Now’ tab will only be available as per the Match time during the live telecast of the Match.
• In the event the PAP uses a SIM card not registered in his name for registration, the Company will not be responsible to track such PAP(s).
• In the event it is not possible to determine with certainty the person who registered from a particular mobile number, that entry would be disqualified. PAP(s) are requested to use phone numbers which are unique to them
• Taking part in the registration process shall be deemed to be acceptance by the PAP(s) to receive promotional messages from the Company or any third party so authorized by the Company.
• The procedures for registration and participation in the PAG are subject to the Terms and Conditions stated herein. Non-conformance by any PAP(s) to the Terms and Conditions will disqualify him/her from participation or winnings, immediately, as the case may be.
• The PAG will be available only in English language.

1. 3. Charges for the PAG

• Downloading MyJio and the playing the PAG is free of cost, however data charges may apply. For further details please contact your telecom operator.
• Please check with your telecom operator for any other applicable charges. In case any user registers while roaming in a different circle/zone/country, additional roaming rates may apply. Please contact your telecom operator for the applicable rates.

1. 4. Features
2. PAG includes features such as Play Along / Prediction Game, Trivia Questions, Poll Questions, etc. ‘You Play Like’ Quiz, Selfie Booth and Offline Games. Only the PAP shall be allowed to participate for the Play Along / Prediction Game as described in clause 4.1 below. The Company shall in its sole discretion keeping the applicable laws in mind, allow users other than the PAP to participate in features other than clause 4.1 below. These features shall be made available by the Company at its sole discretion and all the features might not be available at all times

1. 4.1. Predict per 5 Minutes Slot and Trivia Questions (‘Play Along’):

• From the first minute of the Match, the PAP will have to make a prediction for each 5 minutes slots of the Match prior to the start of the next 5 minute slot and for all the proceeding 5 minutes slots including half times, injury/added time, extra time and penalty shootout time (“Prediction Slot”).
• PAP can earn ‘Points’ basis the correct predictions given by the PAP. For avoidance of doubt, the prediction and respective Points to be earned are listed below
  • Goal – 100 Points
  • Cards – 80 Points
  • Off Side – 60 Points
  • Corner – 40 Points
  • Free Kick – 20 Points
• PAP can also earn 10 Points for each correct answer against 5 (‘Five’) Trivia Questions asked during the PAG at Company’s sole discretion. Please note that Trivia Questions should be answered by PAP within the Stipulated Time to earn points.
• In an on-going PAG, the PAP could lose the opportunity to play for one or more Prediction Slots or answer one or more Trivia Questions (and hence lose opportunity to earn Points) in any of the following scenarios, and the Company shall not liable for these incidents:
  • Where a PAP answers a call / message / etc. on the device where he/she is playing PAG;
  • Where a PAP exits MyJio being used by the PAP in the course of playing the PAG;
  • Where there is a network drop or battery drain-out in the course of playing the PAG;
  • Where the device on which PAG is being played hangs during the course of playing the PAG; and
  • When PAP moves to another app or another page within the MyJio or to the main menu of the PAG.
• Where the PAG or the ability of a PAP to play the PAG is affected by any other network / technical / phone issues, the PAP will be permitted to re-join the PAG only when the next question is asked.
• Points scored by PAP across multiple days will get accumulated for the Tournament. In the event a PAG is terminated mid-session for any reasons whatsoever, the PAP will have to wait till the next Prediction Slot / Trivia Question is made available by the Company during the Tournament, in order to continue scoring Points. Company shall not be responsible in any manner for termination of PAG mid- session or for cancellation of the Tournament for any reason whatsoever.
• Once the prediction is made / answer option is selected, the PAP will not be allowed to change the selected option / answer. If the colour of the selected option / answer does not change, or the server has not received the response, then the PAP would be required to select the option again within the Stipulated Time.
• Only the predictions made / answers received within the Stipulated Time will be considered valid.
• The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of the PAG.
• Scores maintained by the Company or any official scorer as appointed by the Company from time to time will be considered as final. Company shall have the liberty but not the obligation to publish Season Leaderboard, Weekly Leaderboard or Daily Leaderboard (collectively referred to as ‘Leaderboard’) with respect to the aggregate Points scored by the PAP. The Leaderboard will not be displayed for all the PAPs and only top 50 highest scoring PAPs with respective Points shall appear on Leaderboard. The Leaderboard is indicative only, and may not be up to date across all PAPs and the Leaderboard data cannot be used as evidence in any manner. Due to high participation volume, server load, software malfunction, etc., Points calculation may not be immediately correct. In the event, Points calculations are incorrect, Company will correct the same. This could result in changes to the PAP’s Points. Company will have no obligation to intimate any PAP in the event the Points are corrected.

1. 4.2.Poll and Other Questions

• The Company may, at its sole discretion, can ask Poll Questions or any other Questions during the Match.
• The PAP acknowledges and agrees that there shall be no Points awarded by the Company for any such questions other than those mentioned in clause 4.1 above.

1. 4.3.‘You Play Like’ Quiz:

• A PAP may also participate in ‘You Play Like’ Quiz as and when made available by the Company on the PAG homepage, at its discretion.
• PAP shall have to select one option out of four options available for a total of five questions asked during the Quiz. Basis the options selected, the result shall be shown as to which football player you play like.
• PAP acknowledges and agrees that this Quiz and made available only for the purposes of entertainment of the Participants and results are based on predefined backend logics. The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions, backend logics and results thereof.
• PAP also acknowledges and agrees that there shall be no Points awarded by the Company for participating in ‘You Play Like’ Quiz.
• The Company may, in its sole discretion decide to award Prizes to PAPs playing ‘You Play Like’ Quiz.

1. 4.4.Selfie Booth:

• A PAP can also explore ‘Selfie Booth’ as and when made available by the Company on the PAG homepage, at its sole discretion.
• PAP shall have to select his favourite football team out of the available options, take a selfie as per guidelines shown inside Selfie Booth and submit. Once submitted, the face shall be affixed to a male torso and PAP can get to see himself / herself in a male jersey of his / her favourite football team selected.
• PAP also acknowledges and agrees that there shall be no Points awarded by the Company for exploring Selfie Booth.
• The Company may, in its sole discretion decide to award Prizes to PAPs exploring Selfie Booth.

1. 4.5.Offline Games:

• A PAP can play offline games as and when offered by the Company at its sole discretion during the PAG.
• The PAP acknowledges and agrees that there shall be no Points awarded by the Company for playing offline games.
• The Company may, in its sole discretion decide to award Prizes to PAPs playing offline games.

IV. WINNER SELECTION AND PRIZES

• Winner Selection:
  1. Each PAP shall be awarded ‘Prizes’ (as may be decided by Company at its sole discretion), on reaching below milestones (“Winners”):
     • On User Profile Completion
     • Earning 100 cumulative Points
     • Earning 500 cumulative Points
     • Earning 2,000 cumulative Points
     • Earning 10,000 cumulative Points
     • On completion of Profile
  2. Currently, there are no Winners and / or Prizes other than those defined above, however; the Company may, at its sole discretion:
     • Adopt any other methodology or criteria as the Company deems fit to determine Winners;
     • Determine one or more Winner(s) for the PAGs other than those defined above such as Match Winners, Weekly Winners, Tournament Winners (collectively referred to as ‘Bumper Winners’) with the terms and conditions attendant thereto; and shall intimate about such changes from time to time.
  3. If later at any point in time, Company chooses to determine Bumper Winners basis the highest Points scored i.e.; top rank on Leaderboard and there are more than one PAP who have scored the same highest number of points, the Bumper Winner(s) will be determined with the help of randomizer software developed specifically for the purpose of selection of the winners. The randomizer will use an appropriate method of selecting winners to break the tie, at the discretion of Company. In the event of a software failure, or for any other reason, the Company may adopt any other methodology or criteria at its sole discretion to select Bumper Winners from amongst the PAPs, depending upon requirement and availability of time.
  4. Bumper Winners, if any, may be contacted by the Company at its sole discretion to facilitate gratification. The Company will rely upon only such telephonic contact information as may be provided by the Bumper Winner at the time of participation in the PAG (or registration on MyJio) to contact him/her, if required, for the purposes of gratification. The details of the Prize may be intimated by the Company to such Bumper Winner on the mobile number provided by such PAP at the time of registration, on a best effort basis. In such case, the Company will make a maximum of 3 (three) attempts to get in touch with the Bumper Winner. Failure to contact the Bumper Winner may result in forfeiture of the ‘Bumper Prize’, for such PAP and the Company may use such ‘Bumper Prize’ at its sole discretion. Where, the Bumper Winner(s) cannot be contacted telephonically; or after being so contacted (maximum of 3 (three) attempts), the Bumper Winner(s) do not claim the Bumper Prize with sufficient proof of identification as such Bumper Winner(s); or does not claim the Bumper Prize within stipulated time as may be informed by the Company after completing applicable formalities, the Bumper Prize for such Bumper Winner(s) stands forfeited. No further claims by the original Bumper Winner who could not be contacted or does not claim the Bumper Prize, will be entertained and the Company will not be responsible or liable in any way whatsoever.
  5. The details of Prizes shall be made available to the PAPs in ‘My Winnings’ section in the PAG. Details such as sponsor name and details about how to redeem the Prize may be made available in the ‘My Winnings’ section.
• Special Terms and Conditions for Prizes:
  1. With respect to the Prizes, the special conditions applicable, if any, as notified by the relevant sponsor to the Company, will be provided in the My Winnings Section. The Company shall make reasonable endeavours to communicate, such special conditions as may be notified to it by the relevant sponsors from time to time. However, the Company does not guarantee or assure the completeness and accuracy of such special conditions, including any updation or revision thereof from time to time and it shall be the sole responsibility of the relevant Winner(s) to ascertain all conditions pertaining to the Prize won by such Winner directly with the relevant sponsor.
  2. The Company shall not be, in any manner, responsible for any decision taken by a Winner to avail any Prize and any consequences arising from the conditions that may be imposed by the relevant sponsors upon such Winner(s).
• Winner Declaration and Pay-out / Prize(s) handover:
  1. The Company reserves the right, at its discretion, to institute one or more Prize(s) for the PAGs and the terms and conditions attendant thereto, including whether such Prize(s) are daily, weekly, bumper, cumulative, non-cumulative or any combination thereof. Prize(s) so won shall be announced by the Company at its sole discretion.
  2. The Company reserves the right to offer or withdraw any of the Prize(s) as provided herein-under, at any point of time, including after they have been announced.
  3. The PAP hereby acknowledges and agrees that any Points awarded to a PAP under the PAG shall not be construed, under any circumstances, to be a representative equivalent of any monies, prize, benefit, emolument or reward of whatsoever nature. The PAP hereby further acknowledges and agrees that the Points awarded to the PAP under the PAG are merely a notional representation of the performance of the PAP in the PAG in terms of score, and as such, can neither be encashed, transferred nor can be converted in any manner, for any prize, benefit, emolument or reward of whatsoever nature.
  4. The Company may, in its sole discretion, exclude a PAP from participating in any part of the PAG which may include without limitation (i) circumstances which, in the Company's view, renders the PAP unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the PAP; (iii) any other reason that, at the discretion of Company, would adversely impact the Company or the PAG. At no point of time will the Company be obliged to notify unsuccessful PAPs of its decision.
  5. Company will use the mobile number used to register on MyJio by the PAP to identify the Winner of the Prize(s) won, if any. Inability on the part of the PAP to accordingly show or provide the required identification proof could entitle the Company to disqualify the PAP from any winnings, if declared.
  6. Whilst the Company, shall make all reasonable endeavours to (i) enable PAP(s) to proceed with participation in the PAG (ii) to contact all Winner(s), the Company cannot guarantee contact and the Company, as the case may be, shall, at its sole discretion, be entitled to proceed with the next entitled PAPs who are eligible to be Winners under the Terms and Conditions, in case it is unable to successfully contact and communicate with PAP(s)/ Winner(s) in terms hereof.
  7. The Company will have no liability to a PAP who is unable to take part in the PAG for whatever reason and the Company shall be entitled to disqualify the PAP(s) from the PAG at any time, at the discretion of the Company.
  8. The Company further reserves the right to replace at its discretion any Winner(s) who for any reason fails or is disqualified from or unable to participate in the PAG with another PAP who has scored the same number of points and is otherwise eligible to be a Winner, notwithstanding that such PAP may have been previously eliminated from the PAG and each PAP shall agree to collect the Prize(s) as and when required by the Company to do so.
  9. If at any point it is determined by the Company that any person has tampered with MyJio, the PAG, or any data / servers / database / etc. related to the PAG, the Company reserves the right at its discretion to revoke or cancel points or winnings of any such PAP and / or initiate litigation as deemed fit and necessary by the Company.
  10. Any and all taxes and/or levies applicable on the Prize(s) won by the Winner(s) under the laws of India shall be borne by the Winner(s) and/or relevant sponsors in relation to the relevant Prize(s). The Prize(s) to the Winner(s) shall be subject to deduction of all applicable taxes and levies and subject to the relevant Winner(s) providing the relevant documents as may be prescribed by the Company and/or relevant sponsor and subject to the Winner’s adherence to the applicable conditions, including special conditions, for the purposes of availing the Prize(s).
  11. The delivery of any Prize(s), including the terms and conditions applicable thereto, shall be determined by the relevant sponsor thereof. Neither the Company nor the sponsor will be responsible should the Winner(s) refuse to accept and/or be unavailable or incapacitated in any manner whatsoever to accept the Prize(s) as made available.
  12. Where any Prize(s) involves a trip to any destination, the travel dates confirmed by the Company will be final and no changes to the same will be accepted. If the Winner or the companion is not available for the confirmed dates, then the Winner will be disqualified and the Prize(s) will be forfeited. The PAP will be required to send attested copies of a valid passport for the PAP and his/ her companion, PAN card of the PAP and any other documents that will be required to arrange for the PAP’s and companions’ visa within the stipulated time.
  13. The Winner agrees that the delivery of his/her relevant Prize(s) may be delayed as a result of a delay in submission of documents and/ or any force majeure events which are not within the control of the Company.
  14. The Winner hereby agrees that he/ she shall not hold the Company responsible for any delays and/ or disputes and/or claims arising out of any Prize(s) that such Winner may be entitled to, and shall indemnify the Company against any and all such claims.
  15. The Winner hereby agree that any in case of any disputes/ claims arising out of any Prize(s), the same shall be addressed directly to the relevant sponsor of such Prize(s) and the Company shall not be held responsible for the same.
  16. The Company may refuse to pay winnings or reclaim all sums paid to Winners in the event of any fraud, dishonesty or non-entitlement on the part of any of such Winner(s) to participate in the PAG under the Terms and Conditions.

V. PROMOTIONAL ACTIVITIES:

• The Company may, at its sole discretion, promote any products and/or services of its sponsors or third parties during the PAG (“Promotional Activities”). For such Promotional Activities, the Company may provide any PAP with any goods and/or services and/or merchandise (“Promotional Materials”).
• The Promotional Materials may be provided by the Company at any time during the PAG.
• The PAP agrees that any footage or any photographs of any nature of the Promotional Activities shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
• The PAPs who are provided with the Promotional Materials agree that they shall co-operate with the Company and participate in any activity and/or campaign of any nature whatsoever without any money payable to such PAPs.

VI. RESPONSIBLE GAMING:

• The Company cares for its Participants. The Company tries to protect the Participants who are at risk of potential negative effects of online gaming through a number of means. Most people play online for fun and entertainment, but we recognize that a small percentage of people will attempt to play when they’re underage or allow playing online to control them and affect their lives.
• It is illegal for anyone under 18 to participate in PAG. PAG is open for Participants over 18 years of age. We take declaration from users that they are over 18 years of age. We reserve the right to ask for additional age verification information from the user and suspend the user’s account until he/she provides information that verifies appropriate age to our satisfaction. If a user is found to be underage, that user’s account will be terminated. Other legal ramifications may also apply.
• The Company shall on a best effort basis try not to target under-age individuals with marketing /advertising means.
• The Company believes in providing a platform for entertainment and not a platform for making monies. In order to ensure this vision reaches the Participants, the Company does not take real-money or award winners with real money at any time for participating in PAG.
• Responsible gaming means making sure parents understand the importance of supervising their children’s online activities. The internet is readily accessible in many homes in India. As a result, we would like for us and parents to work together to protect children from playing underage fantasy sport.
• Tips for parents:
  • Do not leave children unattended near your mobile phone when you are playing the PAG.
  • Do not allow under aged children to participate in any Daily Fantasy Sports activity.
• If the user is worried about spending a lot of time on PAG then he/ she can self-exclude himself/herself from our website.
• The following highlights a number of questions a user should ask themselves and their loved ones to help identify potential signs of an online gaming problem. While these questions are not a diagnostic, psychological, or medical test and should not be used as such, many people who have called help lines have answered yes to one or more of the following questions:

VII. SYSTEMS AND AVAILABILITY:

• The Company will not be responsible for any break or disconnection or disruption in network connectivity in any manner, irrespective of the network being used. Network issues can disrupt various aspects of the PAG such as receipt of questions and answer options, receipt of any sound, text, image or audio files related to the question, receipt of answer chosen by the PAP, etc. The PAP is advised to remain in an area with a strong and stable/ continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the PAG.
• Any loss or outrage or dissatisfaction suffered by the course of playing the PAG by a PAP would not be the responsibility of the Company and/or its associates/ affiliates and the Company or its associates/affiliates will not be responsible to make good any such loss or dissatisfaction.
• All attempts will be made to protect the data from loss and corruption, but in the event such data loss happens, Company may have to continue with whatever data is available, or in any other manner as it may deem reasonable. The Company should not be held responsible for any loss of data or the action taken on account of the same. The Company will not be held responsible to make good any such loss or dissatisfaction on account of such loss.
• In the event the response of the PAP is not for any reason received within the Stipulated Time period for the question, such PAP would be not be able to get points in the event that question(s) was correctly answered by the PAP. The PAP can continue to answer questions once re-connected to the central PAG game server(s). Company or its vendors and partners are not responsible for any such instances.
• In case multiple entries are received from a PAP for the same question, Company has the right to choose the first answer entry received from that PAP. If multiple entries are received at the same time, then the Company will chose any of the answer entries received. Scores calculated basis this will be considered final and would be updated on the PAG subsequently at a later date.
• Prior to start of play of the PAG, the PAP must check that MyJio is operational and functioning correctly. The PAP is advised to keep adequate RAM and phone memory available to ensure smooth functioning of the PAG. Quitting other applications on the device will also help towards smoother gameplay in case of some phones.
• PAP is advised to keep the device from which the PAG is played, adequately charged. Low battery will result in shut down of the network and / or device and that will result in the PAP not being in a position to play the PAG.
• The server used to communicate with the PAP has adequate redundancies built into it. However, in the rare cases, the server is down during the play, the Company will, at its discretion but not as an obligation, determine such measures as it may deem fit, including cancelling certain sections or segments or question(s) from being scored and/or awarding points to all the players for that section, or any other means at the discretion of the Company.
• Every effort will be made to coordinate the PAG with the SD & HD feeds of the Tournament, such that the live telecast of the Match coincide with the PAG. However, since this is heavily dependent on satellites, networks, receivers, connectivity, cloud issues and various forms of latency, there could be instances of inaccurate alignment. These would be outside the control of the Company or its affiliates/associates and neither the Company nor its affiliates or associates will be responsible for any consequences or liability arising therefrom, to any part whatsoever.
• All PAPs need to adjust the device display, font and resolution to default size or lower to ensure that they are able to play the PAG on their devices properly. If not, then the “Play Now” button might not appear on the device screen during gameplay. In case the PAP is not able to play the PAG on account of this, the Company will not be responsible in any manner whatsoever.
• The PAP acknowledges that all possible issues may not have been identified by the Company and its partners, and agrees to hold harmless the Company and its partners for the application, network, process, technical or any other failures. Any losses, injury, discomfort, loss of privacy, inability to participate or any other discomfort of any sort caused to the PAP or the PAP’s property or device shall not be the responsibility of the Company or its partners.
• No person (i.e., either the PAP, or any person on behalf of the PAP) shall initiate litigation against the Company or its partners in any manner without first providing the Company a complaint at jioengage@jio.com and providing the Company an opportunity to address the complaint.
• In case any unauthorized activity is observed on the PAG, that particular PAP will be disqualified to play till such time as the Company deems fit. The Company would not be responsible in any manner whatsoever on account of such disqualification.
• Company shall not be liable for any failure of the application server or system in the course of playing the PAG.
• The Company shall endeavour to make all reasonably practicable arrangements, it cannot guarantee or assure seamless connectivity or continuous availability of the application, server, system or software to the PAPs during the conduct of the PAG as these are dependent on external utilities/ service providers and factors which could be beyond control of the Company.
• Company and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupt receipt of answers.
• The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the PAP(s) are unable to participate in the PAG due to failure on the part of the telecom operator, facility provider, etc., or due to capacity constraints.
• It shall not be open for the PAP(s) or any of their representatives to require an audit or verification of the randomizer/ selection software or any other criteria, process or system adopted by the Company as part of the process of conduct of the PAG or selection of Winners resulting therefrom. No enquiries, appeals, verbal or written, shall be entertained in this regard.

VIII. CONFIDENTIALITY AND PUBLICITY:

• The Company shall keep all the information (including sensitive personal information) collected from the PAPs confidential and shall not share the information so collected with any party, save and except for the purposes of the PAG. The PAPs hereby agree that the Company may share the information so collected with any third party only for the purposes of the PAG in an anonymised manner. Any information shared by the PAP to the Company shall be handled by the Company in terms of the privacy policy of the Company available at https://www.jio.com/en-in/privacy-policy.
• None of the PAPs shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to any aspect of the PAG. The PAP shall not disclose any information whatsoever relating to the Company to any other party. Violation of this clause shall immediately disqualify the PAP’s prospects of further participation.
• The PAP shall at all times keep confidential all particulars and details regarding the PAG.
• The Company may request one or more PAP to participate in any online/interactive activity relating to the PAG, including without limitation, the recordings of web-casts, interviews, etc. It is a further condition of entry and participation in the PAG that the PAP(s) shall adhere to and where necessary, procure from any and all PAPs thereto, their necessary agreement and execution of the release form as devised from time to time by the Company.
• The Winner(s) of the PAG as announced by the Company from time to time, agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s). Further, the Winner(s)/PAP(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever if required by the Company. The Winner(s)/PAP(s) agrees that the footage of any nature shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity
• Any photographs, videos etc. submitted by the PAPs/Winners to the Company or recorded, shall on submission / creation become the property of the Company and shall be available to the Company for exploitation throughout the world in perpetuity. The PAP(s) shall ensure that the photos or videos submitted by them in any public domain or their performances shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third person. The PAP(s) shall solely remain liable for any action (criminal/civil) arising therefrom.
• Acceptance of these Terms and Conditions by the PAP constitutes permission for the Company, including its affiliates, to click photographs, record videos of the PAP(s) and use the PAP(s) name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.

IX. GENERAL TERMS AND CONDITIONS

• The participation in the PAG(s) shall be considered to be acceptance of these Terms and Conditions.
• The PAP hereby represents that he/she is not under any exclusive contracts with any other third party/ agency or is not under any kind of disqualification under law to enter into an agreement with the Company or its affiliates, as the case may be.
• The PAP shall undertake, warrant and guarantee to the Company that the PAP has the full legal capacity to participate in the PAG in accordance with these Terms and Conditions.
• The PAP acknowledges that he/she has voluntarily chosen to participate in the PAG at his / her free-will and is willing to bear all risk, costs & consequences arising from such participation in the PAG.
• The PAP shall not have any claim against the Company and/or any of its affiliates connected with the PAG for the same. The Company or any of the affiliates connected with the PAG shall not be responsible for any such eventuality and the PAP(s) shall not be entitled to claim any compensation from the Company.
• In the event of any fault, misunderstanding or dispute concerning any part of the PAG, and/or the operation of the telephone system, the selection of Winner at any stage, or the validity of any question or answer options, inaccuracy in scores, failure of technical infrastructure including the feed infrastructure, the decision of the Company shall be final and binding on all PAP(s) and other persons. The Company is empowered to take a decision on any case or instances not covered by the present Terms and Conditions including selection of Winners basis original logs and / or revised logs captured at the sole discretion of the Company and ignoring edge cases / error cases within tolerance limit defined by the Company at its sole discretion.
• The Company reserves the right to amend (add, delete or modify) the Terms and Conditions prospectively or retrospectively, at its discretion and without prior notice, in order to improve the PAG or remedy any issues that occur or for any other reason as the Company may deem fit.
• The Company has the right at any time to terminate the PAG without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the PAG.
• Registration or participation in the PAG does not guarantee a Prize(s) or award.
• If the operation of the PAG; the recording or broadcast of any/all of the Matches is prevented by an event of force majeure or otherwise, the Company may cancel all or any part of the PAG, or take such other decision as it deems fit.
• In case the Winner(s) is found to be in violation of any and all rules/process of the PAG, the Company reserves the right to initiate legal proceedings against such person(s) including but not limited to having the concerned Winner to refund the Prize(s) money together with penalty interest as deemed fit by the Company. If at any time, including after disbursement of Prize(s), any information submitted by the PAP(s) is found to be incorrect, false, or otherwise misrepresented or misleading, the PAP(s) shall be liable to refund all amounts received from the Company/ the Company is liable to reclaim the Prize(s) from the PAP(s).
• The PAP acknowledges and agrees that he/she may receive certain notifications relating to the PAG on their device. At any given point of time, if the PAP decides to not receive notification, he/she may turn off such notifications through app settings.
• If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.
• These Terms and Conditions and the PAG shall be governed by and construed in accordance with the laws of India and the PAP(s) submit irrevocably to the jurisdiction of the Courts in Mumbai.
• The Company is empowered to take a decision on any case not covered by the present Terms and Conditions.
• The Company is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to any PAP(s) and/or the Winner (s) in any manner whatsoever, in relation to the PAG and/or Prize(s).
• The Winner(s) and/or the PAP(s) of the PAG agrees that he/she shall hold harmless the Company, its employees, officers, sub-contractors or any other person in connection with the Prize(s) won by him/her and/or in relation to the PAG including but not limited to the procedure in the PAG and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the Company to claim any damages or reliefs
• The Company or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the PAP(s) and arising as a result of his/her participation in the PAG.
• The Company and / or any of its affiliates shall not be liable for any content provided by third party partners on the PAG.
• The PAP(s) hereby agree to indemnify the Company or its affiliates against any claims that might arise from their actions or omissions while participating in the PAG.
• The only way to enter PAG is through participation as described in Terms and Conditions. There is no other way of entering the PAG. Any person claiming that he/she can help get you wins for a consideration is defrauding you. Please contact your local police and report this person immediately.
